This is a legally binding agreement between you and YF Life governing the terms and conditions under which the Electronic System may be used or accessed. Use or access of the Electronic System implies that you accept all the terms and conditions stated hereunder.

YF Life is the BVI branch office of YF Life Insurance International Ltd, which is incorporated in and under the laws of the Hong Kong Special Administrative Region with limited liability, and is registered as a foreign company under the International Business Companies Act on 4 December 1995 and was voluntarily re-registered under the BVI Business Companies Act (Revised Edition 2020) (the “BCA”) on 1 January 2005.

Principal office of YF Life Insurance International Ltd is situated at 27/F, YF Life Tower, 33 Lockhart Road, Wanchai, Hong Kong.

The BVI branch office is situated at Belmont Chambers, Tropic Isle Building, Nibbs Street, Road Town, Tortola VG1110, British Virgin Islands.

YF Life is supervised, regulated and monitored in the BVI under the Insurance Act (Revied Edition 2020) (the “IA”), the Insurance Regulations (Revised Edition 2020) together with other subsidiary legislation, rules and regulatory guidance by The BVI Financial Services Commission (the “FSC”). Under the IA, YF Life holds a Category B insurance license (the “License”). The License allows YF Life to carry on insurance business (as defined in the IA) in the BVI, including domestic business (as defined in the IA).

YF Life controls and maintains the Electronic System from its principal office in Hong Kong. The material and information contained in the Electronic System refers to the personal details of the customers collected or controlled by YF Life. YF Life do not offer or sell any product, service, promotional or publicity activities in any places in which such offering or sale of the product or service are illegal under the laws of such place. YF Life makes no representation that the material and information contained in the Electronic System is appropriate or available for use in other jurisdictions. All the terms and conditions relating to the Electronic System are governed by the laws of BVI and any dispute shall be subject to the non-exclusive jurisdiction of the courts of BVI.

By accessing Electronic System and / or using the services offered through Electronic System, you shall be deemed to agree that the laws of BVI shall govern such access and the provision of such services; and you shall be deemed to agree to submit irrevocably to the jurisdiction of the courts of BVI.

The distribution of the Electronic System's material (in part or in whole) may be prohibited / restricted by law in certain jurisdictions. It is your responsibility to ensure those prohibitions / restrictions are observed.

Security is a top priority for YF Life. YF Life tries to protect your personal data against unauthorized or accidental access or processing. We do this by:

Owing to unpredictable traffic congestion, openness and public nature of the Internet and other reasons, the Internet may not be a reliable medium of communication and that such unreliability is beyond the control of YF Life. This may subject transactions to delays in transmission, incorrect data transmission, delays in execution or execution of instructions at prices different from those prevailing at the time instructions were given, misunderstanding and errors in any communication between YF Life and you, transmission blackouts, interruptions and so on.

Please note that any software downloaded from the Electronic System is at your own risk, and YF Life neither assumes nor accepts liability for any loss or damage (whether direct or indirect), howsoever caused, as a result of any computer viruses, trojan horses, worms, software bombs or similar items or processes arising from your use of the Electronic System.

All communications, instructions and applications given to YF Life and / or its subsidiaries through the Electronic System with your user ID and login password shall be deemed to be given by you or with your valid authorization, unless and until YF Life receives your written notification that the security of your user ID and login password has been compromised. Before receiving the said written notification from you, YF Life is authorized by you to rely upon and act in accordance with any such communications, instructions and applications without liability. In any event, YF Life may refuse to accept any communications, instructions and applications given through the Electronic System upon such grounds as YF Life deems fit.

YF Life takes prudent security measures to ensure personal data collected through the Electronic System are stored and transmitted under protection.

However, all data collected through the Electronic System is subject to risks of exposing the data to unauthorized access and use.

This Privacy Notice explains how YF Life may collect, use, disclose, transfer and otherwise process “personal data” and / or “sensitive personal data” (each as defined in the Data Protection Act, 2021 which came into force in the British Virgin Islands on July 9, 2021 (the "DPA") and collectively, the “Personal Data”) you provide in connection with the services which we provide to you ("Users"). It provides a high-level outline of the legal bases for the processing of Personal Data and also summarizes certain key rights of individual data subjects under the DPA.

(a) your access to and /or use of the Electronic System and / or any other person's or entity's access to or use of the Electronic System where such person or entity was able to access and use the Electronic System using your user ID and / or login password except where you have fully complied with any guidelines, procedures or instructions relating to the proper use of the Electronic System from time to time notified to you by YF Life whether on the Electronic System or otherwise, including but not limited to your responsibility to exercise due care to keep your user ID and / or login password confidential to prevent fraud and your duty to inform YF as soon as you are aware that the security of your user ID and / or login password may have been compromised and the use of the Electronic System or any of its services is unauthorized; or

(b) any breach or non-observance of any of the above terms and conditions by you or by any other person or entity where such person or entity was able to access and / or use the Electronic System by using your user ID and / or login password.
